Ok, The car insurance is trying to get my mother to pay 50% for a transmission she bought at a dealer ship. Problem is, she just bought it used at 4-5 months ago. They claim it was negligence for not changing the Transmission Fluid. But she did change it at Wal-Mart! Can they still charge her under full warrenty?|||If the car is still under warranty, and it has been properly maintained then they have to fix it. It sounds to me like they are trying to pull one over on your mom claiming that she was negligent, This car is known for problems with the transmission. get a lawyer if need be, and make them pay his fees too!
The car may go a few seconds without tranny fluid, or it could go a long way.|||First you must determine the root cause of the prblem. if the tranny leaks its fluid by itsel, its a waranty problem. if wal-mart put in the wronk fluid, or not enough, then they are liable for full damages, and if this is the case, you need to have it in writing by a certified mechanic, and be adamant with management that it be taken care of. such was the case with my brother in 05'|||So long as she was doing the maintenance on it, and having WalMart change the fluid according to the manufacturers recommendations is sufficient, then she should not have to pay for any repairs.
If the damage was done because she allowed the transmission to run out of fluid, then she is getting out cheap by only having to pay half. Warranty companies do not pay for anything that fails due to normal wear and tear, or anything that fails due to negligence.
If she still has the receipt from WalMart, I would fax that to the warranty company as proof of maintenance.
Prepare to fight a bit for this, the first people you deal with at one of those places, usually work hard to find a reason NOT to pay for damages.|||All she needs is the receipt from Walmart.
You left out a lot of information that would help people answer your question. You never said many miles the car has. How many miles has it been driven since you bought it? Did they say all the maintenance was up to date when you bought it?
You need to know what is the manufacturer recommended interval for changing the transmission fluid?
Go to the dealer and see if they have maintenance records on the car. When was it changed last? It may be possible to go to another dealer and see if it had a extended warranty by the prior owner and see if they can tell you whats been done to the car before you bought it.
Sounds like you need someone who knows cars and is very assertive to go to the dealer with you.

What Kind, If Any, of Fluid Did "Wal-Mart" Mechanic Add? Why Did it need to be Changed after 4 to 5 Months, Should "if Needed" have been Done before you Picked up the Car from the ""dealer""
Depending on the Distance of the Drive and weather it was Completely "Dry", 2 to 4 Days to Destroy the Transmission! But During the time it would be Extremely Noisy!
50% Maybe but then you should goAfter Wal-Mart for that 50% and................
